These Terms govern your use of the Xerevia Health website and mobile application. Please read them carefully before using our Services.
1. Acceptance of Terms
These Terms & Conditions (“Terms”) form a binding agreement between you and Xerevia Health Inc. (“Xerevia,” “we,” “us”) governing your access to and use of the Xerevia website and mobile application (the “Services”). By creating an account, downloading the app, or otherwise using the Services, you confirm that you are at least 18 years old (or are using the Services on behalf of a minor as a parent or legal guardian) and that you agree to these Terms. If you do not agree, please do not use the Services.
2. User Responsibilities
When using Xerevia, you agree to:
- Provide accurate, current, and complete information during registration and check-ins
- Keep your login credentials confidential and notify us of any unauthorized use
- Use the Services only for lawful, personal, non-commercial purposes
- Not attempt to reverse engineer, disrupt, or gain unauthorized access to the Services
- Communicate respectfully with clinicians and support staff
3. Medical Disclaimer
Xerevia facilitates access to licensed clinicians and provides supportive tools such as mood check-ins and AI-generated wellness prompts. Content and features within the app are intended to support, not replace, the relationship between you and your treating clinician, and are not a substitute for professional medical advice, diagnosis, or treatment.
Xerevia is not an emergency service. If you are experiencing a medical emergency, a mental health crisis, or thoughts of self-harm, call 911 or the 988 Suicide & Crisis Lifeline immediately.
4. Intellectual Property
The Services, including all software, text, graphics, logos, and content (excluding content you submit), are owned by Xerevia Health Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from any part of the Services without our prior written consent.
5. Subscription
Certain features of Xerevia are available through a paid subscription, billed monthly or annually as selected at checkout. Subscriptions purchased through the Apple App Store or Google Play are billed and managed through your respective app store account, subject to that platform’s payment terms. Prices are shown before purchase and may change with advance notice; changes will not affect a billing period already paid for.
6. Cancellation
You may cancel your subscription at any time through your Apple ID or Google Play account settings, or by contacting support@xereviahealth.com. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date. We do not provide prorated refunds for partial billing periods except where required by law or app store policy.
7. Limitation of Liability
To the fullest extent permitted by law, Xerevia and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid Xerevia in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for gross negligence or willful misconduct in the provision of clinical care.
8. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, except where prohibited by applicable consumer protection law.
